States have had the option to opt out of these requirements if the Governor of a State has notified the Secretary of Health and Human Services in writing that the State has elected to make the title IV-E requirements inapplicable to the State, or if the State legislature, by law, has elected to make the requirements inapplicable to the State (42 USC 671(a)(20)(B). As of August 2006, Arizona, California, Idaho, Massachusetts, Nebraska, New York, Ohio, Oklahoma, and Oregon had opted out.
